You've not met my neighbours.
Thirty one years of my life blighted by two of the most spiteful, horrible, petty individuals you could wish to meet and it all started the very day we moved in.
 
I think that only the covenant holder can take action if there is a breach of restriction (but IANAL). Are they the covenant holder?

On Saturday I received a solicitors letter from a neighbour who owns the drive over which I have right of way saying my honey and eggs for sale sign on the road is inviting people to trespass on his drive. They also found out that there is a covenant in my deeds cos it’s grade 2 listed that prevents any trades from my property. Consequently my solicitor advised me to take down the sign and stop selling from my property. It’s all very petty but basically I’m a bit knackered now. Anyone else experienced this sort of crap?

Not sure why it being listed would put a covenant on it to stop trading? There are 1000s of business in listed buildings.
 
Look at the situation dispassionately. The right of way was granted for the occupants of the OP's home and their visitors. Suddenly the number of visitors is increased by customers using the right of way at all hours of the day.

I wouldn't be happy if it were my garden they were traipsing or parking on my drive and as the OP seems to be a pretty unreasonable person himself, I'd take the same approach as his neighbour.

(BTW, if you were not made aware of a restrictive covenant when you purchased the property, then you are entitled to take action against the conveyancer...)

Often these things are in place to stop it becoming a shop, or preventing lots of customers visiting with a side effect that it stops people trading full stop. Albeit I don't sell on a huge scale, but I tend to do so via friends, etc esp on social media. Don't know if you could do this, or else, selling to a local shop as middleman?
 
Couldn't agree more, there are some truly despicable 'sorts' out there. Petty, spiteful, unpleasant and the World would be a better place without them.
No doubt they are whiter than white themselves (I doubt it) I hope you find a particularly horrible but very effective way of paying them back ten fold, it's no more than they deserve.

Yes I have lost but I only asked if anyone else had experienced this. I’m not interested in making up and to be sure every dog has his day

I've found through my long life and personal experience that standing on your principles usually costs you money ..

Bite the bullet, grit your teeth, take round a peace offering of eggs and honey and promise a regular supply.

What other options do you have if you have any desire to continue with your farm gate sales ?
 
Sell your honey through a shop it's a lot less hassle and you could probably get the same money for it.
I personally would want people coming to my house all the time for a jar of honey at a time just as I have sat down for my dinner.

A lot of covenants are put in place but when someone discovers them years later there's no one in a position to enforce them. Your solicitor could clarify who can actually enforce yours.

Ignore the neighbours and put the energy to positive use.
 
You may be able to query who imposed the original covenant and make requests to have it removed. Question is whether its worth the money for selling some honey and eggs.

From your tone, I think you would quite happily pay the costs to stick it to him:laughing-smiley-014
