first inspection and i am very confused as well as alittle disheartened

Obviously a chancer who only joined the forum to sell his iffy nucs - ban him if he cannot be more helpful.
Again the matter of commercial posting rears its head - maybe you shouldn't be able to use the for sale section if you have been a member for a certain amount of time - or have X number of posts to your name
 
i am going to leave the hive for a week and have another look,if there is still no sign of a "marked" queen or eggs then i will ask him for a frame with eggs.
on one hand i dont know what that will achieve but maybe i am just trying to give someone the benefit of the doubt.
i suppose i am learning the hard way or maybe i have done something wrong and the colony was perfect when he sold it me,i just dont know.
on the other hand i just want to leave it and get a frame of eggs to keep my colony going so if there is anyone near to Tamworth and would be willing to swap a frame of eggs for a frame of resh foundation i would be grateful.
and dont anyone say "i told you so please,"i feel a numty as it is
 
It was a full colony and it swarmed soon after purchase. Both vendor and buyer have been careless, but given the very low price I would personally give the vendor a bit of leeway.

The buyer has destroyed all queen cells making matters worse. Nevertheless, the vendor has offered to help put things right with an extra frame. The colony will still be viable and still represents good value. I think a sense of proportion is called for here. A witch hunt is a tad extreme.

That's the thing Chris - vendor hasn't offered a frame of eggs, in fact he's just given excuses

no offer of a refund,told me that he didnt have a frame to give me with eggs on

i admit there's been a bit of newbee naivete but all the more reason for the vendor to play fair - I think with the selling of livestock there is some duty of care which carries on after the sale - or there always was in my family anyway.
