9 at present
applied the apiguard treatment 1 hour or so ago but the bees seem very un happy, there flying around the hives, and some are starting a small cluster on the outside of one hive, will they settle down later or should I be worried?

Not unusual ... is it a warm day with you as the 'burst' of thymol when first introduced can upset them. They'll probably settle down.

They usually settle down after a while...or abscond if they are cramped in a bit tight.
 
a bit happier !now guard

all seems ok today they are a bit friskier but all seem to be still with us, there is plenty of room as one hive is in a double brood and the other two are on 14 by 12's and for the time being they also have a super as if there a brood and a half. These two colonies are carnolian bees and to be very prolific so I thourght i'd err on the safe side for the moment.
