173 national & 100 commercial
out with the family today walking over brown Clee, south Shropshire.
Came across about twenty hives on liberty Clee, they need urgent attention. Quite a few roofs missing, a lot blown over.
I did what I could, but obviously having no suit not much. I would say a lot of them need a feed also. If anyone knows who they might belong too, please pass on.
They were all brown painted std national.

I've forwarded the details to our treasurer of the association, and have phoned a few more beeks in the area. hopefully something will become apparent.
As soon as I've heard anything I'll get back to you.
 
I've not heard anything back about the hives HJL.
I've phoned and left messages, emailed and put a post on our association fb page to no avail :hairpull:. its a bit frustrating tbf... I know BKA are slow but this takes the biscuit.

Perhaps it is a beekeeper in a poorly way and unable to get to his colonies... who knows
Get a group of experienced beekeepers together and go put the hives strapped back together and the right way up at least.
Leave a note in the roofs to say what you have done.... I am sure it would be appreciated... in these uncertain times we need a few Good Samaritans.

Contact the local bee inspector they have the legal right to attend and generally have the location and contact details for the owner.
Worked for me a few years back when some land was sold and the new owner was threatening to drive a jcb through the colonies.

I am sure that the Bee Inspectors need to get a warrant if the owners is absent or is refusing inspection, and then there needs to be the suspicion of a notifiable disease in the area.
However this would be a way forward, and you never know the colonies may be registered on BEEBASE... sadly quite a few are not!
I would imagine the Bee Inspector would appreciate some help with the footwork to locate the owner...

This is what I'm aware of. I'll let HJL know, as he said he was going to get the bee inspector on to it.

No they don't although if entering a premises where they think they may be physically prevented they can demand an uniformed police constable accompany them

Are you 100% sure on this? Do you have a link?

Wouldn't that give them more rights of access to a property, than a Constable, with less training and oversight?

Yes, I've read the act, have you? - very similar wording to CEMA (which gives basically the same powers although more far reaching) having entered many premises under that act I can assure you they don't need to swear a warrant.
 
AFAIAW a bee inspector can visit a sight unannounced and if access is available can check any time, climbing over a field gate isn't much of an obstacle but doubt they can force there way on to property.
 
Power of entry.
(1)For the purpose of exercising any power conferred on him by or under section 1 of this Act an authorised person may at any time enter—

(a)any premises or other place; or

(b)any vessel, boat, hovercraft aircraft or vehicle of any other description;

on or in which he has reasonable grounds for supposing there are or have been any bees or other things subject to control under an order under that section.

(2)A person seeking to enter any premises or other place, or any vessel, boat, hovercraft, aircraft or other vehicle in exercise of the power of entry under this section, shall, if so required by or on behalf of the owner or occupier or person in charge, produce evidence of his authority before entering.

(3)Any person who intentionally obstructs a person acting in exercise of the power of entry under this section shall be liable on summary conviction, or, in Scotland, on conviction by a court of summary jurisdiction, to a fine not exceeding [F1level 3 on the standard scale].


In this Act—

  • “authorised person” means a person generally or specially authorised in writing by the responsible Minister;
  • “bees” includes bees in any stage of their life cycle;
  • “bee product” means any natural product of the activities of bees (such as, for example, honey or beeswax) in its natural state; and
  • “the responsible Minister” means—
(a)in relation to England, the Minister of Agriculture, Fisheries and Food; and

(b)in relation to Scotland and Wales, the Secretary of State.
 
In a former life I used to access property under the Gas Act... suspicion of a gas leak... worked with the Met!
No Warrant needed!

We sometimes (well, pretty often) had to search premises in the less salubrious areas of Swansea (Townhill/Ravenhill) the one stipulation of CEMA was that if we were entering a premises after dark we had to have the plod present. When we requested this the answer from the localstation was invariably "you won't catch us in that area after dark! can't you make it a dawn raid?"
